01Who these Terms apply to

These Terms apply to anyone who visits, browses or otherwise uses the Website, whether or not you make an enquiry or purchase a vehicle from us. Nothing in these Terms limits any rights you have under the Australian Consumer Law (ACL) or other legislation that cannot be excluded, restricted or modified by agreement.

02Nature of the Website — no contract formed by browsing

The Website is provided for general information about our vehicles, builds, pricing and dealership services, and to let you make enquiries, request quotes, book test drives or express interest in a vehicle. Browsing the Website, submitting an enquiry form, or paying a holding deposit does not, by itself, create a binding contract of sale between you and us.

A sale is only formed when we and you sign a separate vehicle order or sale agreement (or other document we specifically identify as forming a contract), which will set out the final price, specifications, delivery timing, and terms of sale. Where a deposit is taken to hold a vehicle or build slot, we will tell you at the time whether it is refundable and in what circumstances.

03Vehicle information, pricing and availability

We take care to keep vehicle listings, specifications, build options, images and pricing on the Website accurate and up to date, but:

• Stock, availability, build slots and delivery timing can change without notice, including due to manufacturer supply, compliance or production changes.
• Images are representative and may show optional accessories, different colours, trims or configurations to the specific vehicle available to you — always confirm exact specifications and inclusions with our sales team before ordering.
• Pricing may exclude on-road costs, statutory charges, delivery and optional extras unless stated otherwise, and is subject to change without notice, including in response to manufacturer price changes.
• If a pricing, specification or availability error appears on the Website, we will correct it as soon as we become aware and will not be bound to sell a vehicle at an incorrect price — we'll contact you to confirm the correct price or offer a refund/cancellation if you've already paid a deposit based on the error.

Nothing in this section limits your rights under the ACL — if we've made a false or misleading representation about a vehicle's price, condition or features, that is a separate matter from an obvious pricing typo, and you should raise it with us directly (see Section 11).

04Finance and insurance referrals

Where you ask us to help arrange finance, we act only as an introducer: we pass your contact and enquiry details to a finance broker, who will deal with you directly and assess any application under their own terms and privacy policy. We are not a credit provider, do not assess or approve finance, and any finance approval, offer or contract is strictly between you and the broker or financier.

05Acceptable use of the Website

When using the Website, you agree not to:

• Use it for any unlawful purpose, or in a way that infringes the rights of, restricts or inhibits any other person's use of the Website.
• Attempt to gain unauthorised access to the Website, our systems, or any account or data not belonging to you.
• Use any automated system, bot, scraper or data mining tool to extract content, pricing or vehicle data from the Website without our prior written consent.
• Upload or transmit any virus, malicious code, or material that is defamatory, offensive, or infringes any third party's intellectual property or other rights.
• Submit false, misleading or fraudulent information through any enquiry, booking or contact form.

We may suspend or restrict your access to the Website, without notice, if we reasonably believe you've breached these Terms or your use poses a security or legal risk to us or others.

06Intellectual property

Unless otherwise indicated, all content on the Website — including text, vehicle descriptions, images, logos, the RV Sales Australia name and branding, layout and design — is owned by us or used under licence (including from vehicle manufacturers and distributors such as Mercedes-Benz Vans Australia Pacific and Volkswagen) and is protected by copyright, trade mark and other intellectual property laws.

You may view, download and print material from the Website for your own personal, non-commercial use in connection with enquiring about or purchasing a vehicle from us. You must not reproduce, republish, distribute, modify or commercially exploit any content from the Website without our prior written consent.

07Third-party links and embedded content

The Website may include links to, or embedded content from, third-party websites and platforms — including Google, Meta (Facebook/Instagram), YouTube, our finance broker partners, and manufacturer sites. We don't control these third parties and aren't responsible for their content, availability, privacy practices or terms of use. Any interaction you have with a linked or embedded third-party service is governed by that third party's own terms.

08Reviews, testimonials and submissions

If you submit a review, testimonial, comment or other content to us (for example, by email, form or social media) for potential use on the Website or in our marketing, you confirm it is honest, accurate and your own work, and you grant us a non-exclusive, royalty-free licence to reproduce, edit for length or clarity, and publish it in connection with promoting our business. You can ask us to remove a submission at any time by contacting us.

09Consumer guarantees under the Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Where our goods or services are supplied to you as a consumer within the meaning of the ACL, you are entitled to the benefit of statutory guarantees that cannot be excluded, including guarantees as to acceptable quality and fitness for purpose.

10Liability

To the maximum extent permitted by law, and subject to Section 9, we exclude all warranties, guarantees and conditions not expressly stated in these Terms, and we are not liable for any indirect, special or consequential loss arising from your use of the Website, including loss of profits, loss of data, or loss arising from reliance on Website content that is later corrected under Section 3.

Where the ACL implies a guarantee into these Terms that cannot be excluded but our liability for breach can be limited, our liability is limited (at our option, and where fair and reasonable to do so) to supplying the relevant goods or services again, or paying the cost of having them supplied again. This limitation does not apply to a failure of a kind referred to in section 64A(3) of the ACL (major failures, death, personal injury, or goods of a kind ordinarily acquired for personal, domestic or household use).

We don't seek to limit or exclude any liability that can't lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11Complaints and disputes

If you have a complaint about the Website, a vehicle, or our conduct, please contact us using the details in Section 13 with as much detail as possible so we can investigate and respond. If we can't resolve a complaint directly, you may also contact Consumer Affairs Victoria, the Department of Energy, Mines, Industry Regulation and Safety (WA), or the ACCC, as applicable.

12Changes to these Terms

We may update these Terms from time to time to reflect changes in our business, the Website, or the law. The current version will always be available on the Website, with the "last updated" date shown at the top. Continued use of the Website after changes take effect means you accept the updated Terms.

14Governing law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from those courts, regardless of where in Australia you access the Website from.

15General

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down to the minimum extent necessary, and the rest of these Terms will continue to apply. These Terms, together with our Privacy Policy and any signed vehicle order or sale agreement, constitute the entire agreement between you and us in relation to your use of the Website.
